SEXUAL HARASSMENT
Typically, sexual harassment has meant sexual advances made by someone of power or authority who threatens firing, lack of promotion, or some other sanction if sexual activity is declined. A sexual advance that is politely made and that carries no threat of sanction is not sexual harassment, although some offended workers have interpreted such advances that way. The problem area in sexual harassment pertains to a sexual advance from someone of a higher status to someone of a lower status. The person of lower status may feel pressured to say yes even though no sanction has been made explicit.
However, sexual advances are not the only criteria for sexual harassment. If jokes and sexual innuendos permeate the workplace or school environment so that workers or students feel uncomfortable, unable to perform well, and suffer in their careers as a result, that in itself qualifies as sexual harassment. Furthermore, even if the institution is unaware that such harassment is occurring, the Supreme Court ruled in Meritor Savings Bank v. Vinson in 1986 that the company is still legally liable for the results of such harassment. It is for this latter reason that businesses and universities have instituted educational programs to notify supervisors that sexual harassment will not be tolerated in their organizations.
